These ``Sundrug Fan Community'' Terms of Use (hereinafter referred to as ``these Terms'') apply to users when using the circle established and operated by Sundrug Co., Ltd. Article 2 Application

These Terms are intended to define the rights and obligations between the Company and Participating Users regarding the use of this Circle, and apply to all relationships between Participating Users and the Company regarding the use of this Circle.
The rules and regulations regarding this circle established by our company from time to time shall constitute a part of these Terms.
The Sundrug Group Membership Terms and Conditions shall also apply to the use of this circle.

Article 3 Participation

Those who wish to participate in this circle agree to comply with these Terms and provide certain information specified by the Company (hereinafter referred to as "registration information") to the Company in the manner specified by the Company. By doing so, you will complete the procedures for participating in this circle.
Upon completion of the procedures stipulated in the preceding paragraph, a contract regarding the use of this Circle in accordance with the provisions of these Terms (hereinafter referred to as the "Usage Agreement") will be established between the Participating User and the Company, and the Participating User will not be able to use this Circle. You will be able to use it in the manner specified by our company.
If the Company determines that the person applying for participation may fall under any of the following reasons, the Company may refuse participation in this Circle.
1. (1) If the Company determines that there is a risk of violating these Terms of Use
2. (2) If there is any falsehood, error, or omission in all or part of the registered information provided to the Company.
3. (3) If you have withdrawn from this circle or been suspended from using it in the past.
4. (4) If the person is a minor, an adult ward, a person under curatorship, or a person under assistance, and the consent, etc. of a legal representative, guardian, curator, or assistant has not been obtained.
5. (5) Organized crime group members, persons who have ceased to be a member of an organized crime group for less than five years, quasi-members of an organized crime group, persons belonging to a company affiliated with an organized crime group, a person who belongs to a special intelligence crime group, etc., racketeers, etc., thugs claiming to be involved in social movements, terrorists, etc. , persons designated by the Japanese government or foreign governments as subject to economic sanctions (hereinafter referred to as “organized crime group members, etc.”), persons living with organized crime group members, etc., and other equivalent persons (hereinafter referred to as “antisocial forces, etc.”). ).

Article 4 Changes to registered matters

If there are any changes to the registered information, Participating Users shall notify the Company of such changes without delay by the method specified by the Company, and shall submit the materials requested by the Company.

Article 5 Use of this circle

Participating Users may use this Circle according to the method specified by the Company only during the period of valid participation in this Circle. However, based on our discretion, we may restrict some functions or use of this circle to only specific participating users determined by our company.
Participating Users are aware that the information they send in this Circle (including the nickname used by Participating Users at the time of transmission; the same applies hereinafter) will be made public to everyone who can view this Circle. However, users shall send and receive information at their own risk, and the Company shall not be responsible in any way to participating users regarding the sending, receiving, or disclosure of such information.
When using this Circle, Participating Users must not engage in acts that fall under any of the following items (hereinafter referred to as "prohibited acts").
1. (1) Acts that infringe on the intellectual property rights, portrait rights, privacy rights, reputation, and other rights or interests of the Company, other participating users, or third parties.
2. (2) Act of transmitting personal information of other participating users or third parties
3. (3) Acts of asking for personal information of other participating users or third parties
4. (4) Acts related to criminal acts or acts that violate public order and morals
5. (5) Acts that violate laws or the internal rules of the industry organization to which you belong.
6. (6) Acts of using this circle for the purpose of political activities, religious activities, election activities, etc.
7. (7) Acts of transmitting harmful computer programs such as messages containing computer viruses
8. (8) Acts of posting or transmitting content for the purpose of meeting directly with other participating users.
9. (9) Advertising and publicity to other participating users, solicitation, sales of goods, use for commercial purposes, and other acts of sending messages that are not originally intended to be sent.

11. (11) Acts that may interfere with the operation of this circle
12. (12) Other acts that our company deems inappropriate.
13. (13) Acts that are considered to aid or encourage acts that fall under each of the preceding items (including, but not limited to, acts of posting links to applicable content, etc.)
If the Company determines that the act of transmitting data by a participating user in this circle falls under, or is likely to fall under, any of the items in the preceding paragraph, the Company shall, without prior notice to the participating user, You may delete all or part of the information (including prior display restrictions and transmission restrictions). In addition, if the Company determines that the act of transmitting data of another participating user falls under any of the items in the preceding paragraph, or is likely to fall under any of the above, and the Company deletes that information, the information will be deleted. Otherwise, it may become impossible to view, and participating users agree to this. Please note that our company has the authority to take such measures, but is not obligated to do so. The Company shall not be liable for any damage caused to Participating Users due to the Company taking or not taking certain measures based on this section.
The Company saves text, pictures, audio, video, computer programs, and other copyrighted works (hereinafter referred to as "Circle Works") written in or attached to messages sent and received by participating users and their attached files. The Company is not obligated to do so, and the Company may delete messages sent and received by Participating Users at its discretion, and the Company shall not be responsible for any damage caused to Participating Users based on the measures taken by the Company pursuant to this section. not.

Article 6 Suspension or interruption of this service

In the event that any of the following applies, the Company may permanently suspend or temporarily suspend all or part of the use of this Circle without prior notice to participating users. .

(1) When regularly or urgently performing inspection or maintenance work on computer systems related to this circle.
(2) If computers, communication lines, etc. stop due to an accident.
(3) If the operation of this circle becomes impossible due to force majeure such as fire, power outage, natural disaster, etc.
(4) In other cases where the Company determines that suspension or interruption is necessary.

In addition to the preceding paragraph, the Company may suspend the operation of the Circle or dissolve the Circle at any time at its discretion.
The Company shall not be responsible for any damage caused to Participating Users based on the measures taken by the Company pursuant to the preceding two paragraphs.

Article 7 Attribution of rights

All ownership rights and intellectual property rights related to this circle belong to our company or those who have granted license to our company, and the license to use this circle based on these terms is the license to use the intellectual property rights related to this circle. does not mean. Participating Users shall not engage in any acts that may infringe on the intellectual property rights of the Company or those who have granted licenses to the Company for any reason (including, but not limited to, disassembling, decompiling, and reverse engineering). ).
Participating Users agree that the Company may freely reproduce, modify, transmit, publish, and otherwise use the Works within the Circle that are sent within the Circle, and in this section, the Participating Users agree that the Works within the Circle may be freely reproduced, modified, transmitted, published, and otherwise used. We hereby authorize you to perform such acts of use and to sublicense such acts of use to third parties. Participating Users shall not exercise any moral rights (publication rights, name display rights, and identity preservation rights) against the Company or anyone sublicensed by the Company for the use of works within the Circle.

Article 8 Notifications, advertisements, questionnaires, etc.

Our company may notify participating users of important information regarding this circle by means such as circle messages and e-mails. Participating Users agree in advance to receive such notifications.
Our company refers to information related to our company (advertisements of our company, advertisements of companies licensed by our company, circle introductions of our company, interviews conducted by our company, information on surveys and campaigns, and related communications, etc.), information and communications regarding our services, etc. (The same shall apply hereinafter.) may be sent to Participating Users via circle messages, circle banners, e-mails, etc., and Participating Users shall consent in advance to the sending of such e-mails, etc. Masu. However, this does not apply to participating users who have notified the Company of their cancellation of reception using the method prescribed by the Company.
If a message requesting a response from a Participating User, such as an invitation to an interview or questionnaire, is sent to a Participating User based on the preceding paragraph, the Participating User shall respond or not respond to such message at his/her own discretion and responsibility. I assume that. If a Participating User provides a response, the Company shall not be responsible for the use of such response by the party to whom the response was sent or by any person who obtains the response from the party.

Article 9 Withdrawal, etc.

If a Participating User falls under any of the following items, the Company will, without prior notice or demand, withdraw the Participating User from this Circle or temporarily suspend the use of this Circle. You can stop.
1. (1) If you violate any of the provisions of these Terms.
2. (2) If it is discovered that the registered information contains false information, or if the Company is not notified of changes to the registered information as provided in these Terms of Use.
3. (3) If you use or attempt to use this Circle for any purpose or method that may cause damage to the Company, other participating users, or a third party.
4. (4) If you have not used this circle for more than 6 months and there is no response to contact from our company.
5. (5) If a participating user is found to fall under antisocial forces, etc.
6. (6) In other cases where the Company determines that it is inappropriate for the Participating User to continue using this Circle.
If the disposition set forth in the preceding paragraph is taken, Participating Users must immediately stop any use of this Circle.
The Company shall not be responsible for any damage caused to Participating Users due to actions taken by the Company pursuant to this article.

Article 10 Disclaimer of Warranty and Disclaimer

Our company does not guarantee that other participating users will participate in this circle, that the desired information can be obtained in this circle, that the participating users who participated in this circle actually exist, and that the participating users who participated in this circle have rights and rights. We do not guarantee that the participating users who participate in this circle will not fall under the category of anti-social forces, etc. Furthermore, even if a Participating User obtains information about the Circle or other Participating Users directly or indirectly from the Company, the Company does not provide any warranty to the Participating Users beyond what is stipulated in these Terms. It's not a thing.
.Participating Users shall investigate at their own responsibility and expense whether or not their use of this Circle violates laws and regulations applicable to Participating Users. We do not guarantee that use will comply with laws and regulations applicable to participating users.
Unless there is intentional or gross negligence on the part of the Company, the Company may interrupt, suspend, disable or change the operation of the Circle, delete or lose messages of participating users, delete information of participating users, or delete the information of participating users. The Company shall not be responsible for compensation, compensation, or reimbursement for any withdrawal or suspension of use of the Circle, loss of data or failure or damage to equipment due to the use of the Circle, or any other damage, loss, or expense incurred by participating users in connection with the Circle. In addition, "damages, losses and expenses" in this section include not only direct damages and ordinary damages, but also lost profits, loss of business opportunities, loss of data, business interruption, and other indirect, special, and derivative damages. or all incidental damages.
The Company does not assume any responsibility for the truthfulness of the content of the messages or the results of actions taken by participating users based on the content of the messages.
Although there may be links to other websites from messages and circle windows, or links to this circle from third parties, we do not provide any information regarding websites other than this circle and information obtained therefrom. We shall not be held responsible for any reason whatsoever.

Article 11 Dispute settlement and compensation for damages

If a Participating User causes damage to the Company by violating these Terms or in connection with the use of this Circle, the Participating User must compensate the Company for such damage.
If a Participating User receives a complaint from another Participating User or any other person in connection with this Circle, or if a dispute arises with such person, the Participating User shall immediately notify the Company of the content, and the Participating User's The Company shall handle such claims or disputes at its own expense and responsibility, and shall report the results to the Company upon request from the Company.
If the Company receives any claim from a third party due to infringement of rights or any other reason in connection with the use of this Circle by a Participating User, the Participating User shall be liable for the amount that the Company is forced to pay to the third party based on the claim. must be compensated for.
The provisions of these Terms that exempt the Company from liability for damages do not apply if the Company assumes liability based on non-performance or tort. However, even if the provisions of this agreement exempting the Company from liability for damages are not applied pursuant to this paragraph, the scope of damages to be borne by the Company shall be as follows, unless there is intentional or gross negligence on the part of the Company. The liability shall be limited to normal damages directly incurred by the Participating User.

Article 12 Validity period

The usage contract between the Company and Participating Users based on these Terms shall be between the Company and Participating Users from the date on which the participation procedures based on Article 3 are completed for the Participating Users until the date on which the Participating Users withdraw from this Circle. shall remain in full force and effect. However, if this circle is disbanded, the usage contract will end at that point.

Article 13 Changes to these Terms

The Company may freely change the contents of these Terms (including rules and regulations regarding the Circle separately established by the Company; hereinafter the same shall apply in this Article).
If the Company changes the contents of these Terms, it will display or make an announcement in a place designated by the Company, such as this circle or the Company's community top page. Changes to these Terms will become effective after the period specified by the Company has elapsed after the display or notification.

Article 14 Contact/Notification

Inquiries regarding this circle and other communications or notifications from participating users to the Company shall be made in the manner determined by the Company.
Contacts or notifications from our company to participating users shall be made by displaying or announcing them in our circle, our community top page, or other locations designated by our company, or by sending messages to e-mails, etc., and at the time the display or notification is made. The contact or notification is deemed to have been completed when the message reaches you via , email, etc. If the Company is unable to send an e-mail to the e-mail address that the Participating User has submitted to the Company due to reasons attributable to the Participating User, the notification will be deemed to have arrived at the time the e-mail is sent. .

Article 15 Transfer of these Terms, etc.

Participating Users may assign, transfer, set collateral, or otherwise dispose of their status in the usage contract based on these Terms or the rights or obligations based on these Terms to a third party without the prior written consent of the Company. I can not do it.

Article 16 Governing law and competent court

The governing law of these Terms of Use shall be Japanese law, and the Tokyo District Court shall have the exclusive jurisdiction of the first instance for any disputes arising from or related to these Terms of Use.
